Statement from the Secretary of Labor on Supreme Court Ruling on Vaccination/Testing Emergency Temporary Standard

As you are likely aware, last week, the U.S. Supreme Court upheld the stay on implementation of OSHA’s emergency temporary standard on COVID-19 vaccination and testing. We also want to ensure that you are aware that in response, Secretary of Labor Marty Walsh issued a statement expressing his disappointment in this decision.

OSHA will be evaluating all options to ensure workers are protected from COVID-19, and regardless of the ultimate outcome of these proceedings, will do everything in its existing authority to hold businesses accountable for protecting workers on the job, including under the COVID-19 National Emphasis Program and General Duty Clause.  OSHA also has comprehensive COVID-19 guidance to help employers meet their obligations.
