Abstract:

As COVID-19 cases continue to proliferate, so do the number of disinfectants, sanitizers and cleaning products that are claimed to be effective against the virus.   This presentation addresses the regulation of COVID-19 efficacy claims for cleaners, sanitizer and sterilizer products treated as “pesticides” by the US EPA under the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”) and for products treated as “drugs” by the FDA under the Federal Food, Drug and Cosmetic Act (FFDCA).  Importantly, products in both categories may be used in the workplace as well as the home. 

The speakers will discuss the standards applied by US EPA for determining that a product is a “pesticide” and by the FDA to determine that a product is a “drug.”  The speakers then will explain what claims are allowed and what claims are prohibited, and what information they should look for in screening these products for use in the workkplace.  The speakers will summarize policies that US EPA has published recently to facilitate the registration of products with valid COVID-19 claims, and steps that EPA and FDA have taken to enforce labeling standards.

Stanley W. Landfair

 

Stan Landfair counsels and represents companies in the chemicals, aerospace, electronics and other manufacturing industries on environmental compliance matters and represents them in environmental enforcement proceedings and other litigation matters. He has represented clients before state and federal administrative agencies and forums, state and federal trial and appellate courts and the US Supreme Court.

Stan is known for his experience in the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the Toxic Substances Control Act (TSCA) and counterpart laws in California that regulate the manufacture, distribution, sale and use of pesticides and other chemical products.  He is a recognized authority on "Proposition 65,” the State's Safe Drinking Water and Toxic Enforcement Act of 1986.  

 

Robert S. Schuda

Bob is a partner in the Dentons US Environmental Department, is located in California, and has focused on Environmental, Societal and Corporate Governance (ESG) issues for more than 25 years. During that time, Bob has enhanced client performance as stewards of nature and the environment through providing legal advice in the areas of compliance with clean air, soil, and water laws; hazardous waste generation, minimization and cleanup; environmental planning and historic preservation; due diligence in real estate transactions; manufacturing and registering products making pesticidal claims; growing clean and healthy food crops while preserving natural resources; and providing warnings to consumers where required related to ingredients in consumer products. This representation extends to the courtroom and to matters in front of environmental regulatory agencies.

Bob also provides advice in the area of California’s Transparency in Supply Chains Act, which requires disclosure of certain actions taken to combat slavery and human trafficking in the supply chain. Bob is particularly skilled at identifying efficiencies and in developing favorable outcomes in complex matters.
